Terms of Service

Welcome to Hostopy.com. These Terms of Service ("Terms") govern your purchase and use of all Hostopy services, including Web Hosting, Domain Names, VPS, and IT solutions. By using our services, you agree to be bound by these Terms.

1. Account Eligibility

By registering for our services, you represent and warrant that:

• You are eighteen (18) years of age or older.
• You are providing true, accurate, current, and complete personal information.
• You agree to keep your account login details secure. You are entirely responsible for any activity that occurs under your account.

2. Payment and Billing

• Invoices: Invoices are generated 7-14 days before the due date. You agree to pay for the services in advance of the time period during which such services are provided.
• Late Payments: If an invoice remains unpaid 3 days after the due date, your service may be suspended. If it remains unpaid for 30 days, your account may be terminated and all data deleted.
• Price Changes: Hostopy reserves the right to change the monthly payment amount and other charges at any time with 30 days' notice.

3. Acceptable Use Policy (AUP)

You agree not to use Hostopy services for any of the following prohibited activities:

We reserve the right to immediately suspend or terminate any account found violating these rules without refund.

4. Resource Usage (Shared Hosting)

To ensure fairness for all customers on shared servers, individual accounts are limited in their resource usage. You may not:

• Use 25% or more of system resources (CPU, Memory) for longer than 90 seconds.
• Run public-facing file upload/sharing sites (like RapidShare).
• Run cryptocurrency miners or peer-to-peer (torrent) networks.

If your account exceeds these limits, we may request that you upgrade to a VPS or Dedicated Server.

5. Backups and Data Loss

While we perform courtesy system backups for our own disaster recovery purposes, you are solely responsible for maintaining copies of your own data.

Hostopy.com assumes no liability for any loss of data, including but not limited to hardware failure, data corruption, or accidental deletion. We strongly recommend you download your own backups via cPanel regularly.

6. Uptime Guarantee

We strive to maintain a 99.9% Network Uptime. This guarantee excludes:

• Scheduled maintenance (which we will notify you of in advance).
• DDoS attacks or force majeure events.
• Downtime caused by client error (e.g., coding errors in your website script).

7. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. Hostopy.com makes no warranties, expressed or implied, that the services will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

In no event shall Hostopy.com, its directors, employees, or agents be liable for any indirect, special, incidental, or consequential damages (including lost profits or lost data) arising out of the use or inability to use our services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Jalandhar, Punjab.
